Bergs Chiller Warranty Policy
At Bergs Recovery Pty Ltd, we take pride in delivering high-performance chiller systems designed for durability and efficiency. This 12-month limited warranty ensures protection against manufacturing defects while outlining essential conditions for warranty coverage.
1. Warranty Coverage
Bergs provides a 12-month warranty from the date of dispatch, covering defects in materials and workmanship under normal use and proper maintenance.
What Bergs Will Do:
- Repair or replace defective components at our discretion.
- Cover parts and labor costs for warranty repairs.
- Perform repairs during AEST business hours (excluding public holidays).
- Ensure compliance with Australian Consumer Law (ACL):
- If a major failure occurs, customers are entitled to a replacement, refund, or compensation for reasonably foreseeable loss or damage.
Important Conditions:
- All warranty claims are subject to technical evaluation by Bergs. If the issue is caused by external factors, improper installation, or misuse, the claim will be denied.
- Bergs is not responsible for indirect losses, including lost revenue, downtime, or consequential damages.
2. Exclusions from Warranty
The following are NOT covered under this warranty:
2.1 Electrical & Environmental Factors
- Incorrect power supply, voltage fluctuations, over-voltage, or power surges.
- Damage caused by storms, fires, floods, vandalism, or natural disasters.
2.2 Improper Installation
- Installation not performed by a Bergs-approved or Qualified Technician.
- Any unauthorized modifications or alterations to the system.
2.3 Unauthorized Accessories & Components
- Use of non-Bergs-approved parts, accessories, or modifications.
2.4 Weathering & Corrosion
- Exposure to corrosive chemicals, excessive humidity, or saltwater.
- Normal wear and tear on external surfaces, coils, or non-functional parts.
2.5 Access-Related Costs
- Additional travel, freight, or labor expenses if the unit is located in a restricted or remote area (beyond 100km from a major metropolitan service zone).
2.6 Mobile & Relocated Installations
- Units relocated from their original installation site (unless Bergs oversees the relocation).
- Installations in transportable environments (e.g., caravans, boats, mobile applications).
2.7 Consumables & Maintenance-Related Issues
- Refrigerant gas, filters, fuses, and batteries (unless defective at purchase).
- Performance issues due to lack of proper maintenance.
2.8 Misuse & Operating Beyond Specifications
- Operation outside the recommended temperature or environmental conditions.
- Negligence, misuse, or improper operation.
2.9 Pool Size Compatibility
- Warranty coverage is void if the chiller is used on a pool exceeding the advertised pool size capacity (in litres) as specified in the product documentation, unless such use has been explicitly approved in writing by James or Chevy from Bergs Recovery Pty Ltd.
⚠ Any unauthorized repairs or servicing by a non-Bergs-approved technician will immediately void the warranty.
3. Customer Responsibilities
To maintain warranty eligibility, customers must:
3.1 Proper Installation
- Ensure installation is done by a Bergs-approved or Qualified Technician.
- Retain installation records as proof.
3.2 Routine Maintenance
- Follow the maintenance schedule outlined in the Bergs Product Manual.
- Perform regular servicing and cleaning.
- Keep maintenance records (required for any warranty claims).
3.3 Issue Reporting
- Report any defects within 48 hours of detection.
- Do not continue using a faulty unit, as this may void the warranty.
3.4 Compliance with Updated Guidelines
- Follow the latest maintenance updates issued by Bergs.
⚠ Failure to meet these responsibilities may result in claim denial.
4. How to File a Warranty Claim
4.1 Claim Submission Process
Customers must submit the Warranty Claim Form (available on the Bergs website) along with:
- Proof of purchase (invoice).
- Installation certificate (from a qualified technician).
- Maintenance records.
- Photos/videos of the issue.
4.2 Claim Review & Resolution
- Claims are acknowledged within 24 hours.
- Initial assessment within 2 business days.
- If approved, Bergs will repair or replace the unit.
- If denied, Bergs will provide a written explanation and a repair quote (if applicable).
⚠ Incomplete claims will not be processed. Customers must provide all required documents.
5. Remedies for Major Failures
If a major failure occurs, customers may choose:
- A replacement unit (new or refurbished).
- A refund of the purchase price, subject to returning the defective unit.

6. Service Timeframes
- Standard warranty repair timeframe: 2–10 business days, subject to parts availability.
- Expedited repairs may be available for critical failures (additional charges may apply).

7. Use of Owner’s Preferred Technician
- Customers may use an independent technician ONLY IF pre-approved in writing by Bergs.
- Unauthorized repairs will void the warranty.
8. Audit Rights & Non-Compliance Consequences
Bergs may conduct random audits to verify:
- Proper installation and maintenance compliance.
- Validity of warranty claims.
If an audit finds non-compliance, Bergs may:
- Void the warranty.
- Deny future warranty claims.
- Suspend support services until corrective action is taken.
9. Limitation of Liability
- Bergs’ total liability is capped at the order value.
- Bergs does not cover indirect damages, including:
- Lost revenue or profits.
- Business downtime.
- Third-party damages.
⚠ Bergs is not liable for indirect, incidental, special, or consequential damages, including business losses, reputation damage, or data loss.
