Terms and Conditions
We are confident you'll love your commercial ice bath chiller from Berg’s Chillers. To prove it, we offer a 30-day performance guarantee. If, for any reason, the chiller does not meet your performance expectations within the first 30 days from the delivery date, we will refund your purchase price and arrange pickup at our expense.
Please read the following terms and conditions carefully:
1. Guarantee Period:
The guarantee is valid for 30 days from the date your ice bath chiller is delivered.
2. Performance Expectations:
The chiller is guaranteed to hold the agreed target temperature within a 1°C differential (+/- 1°C). Our chillers are intentionally designed to cycle on and off once they achieve their target temperature, ensuring efficiency and longevity.
We guarantee this performance standard at least 98% of the operating time. (Please note: The allowance for the 2% variance accounts for uncommon scenarios involving sudden, substantial increases in heat load—such as a large group of swimmers entering simultaneously at the end of an off cycle. Such scenarios are uncommon but will be clearly explained to you prior to delivery.)
3. Eligibility for Return:
To be eligible for this guarantee, you must have consulted with James or Chevy at Berg’s Chillers prior to purchase to confirm the correct chiller sizing based on your specific pool requirements. This assessment includes, but is not limited to:
- Pool size and water volume
- Number of swimmers using the pool
- Power supply and electrical requirements
- Integration with saunas or other heat sources
- Desired target temperature
- Structural or building limitations that may affect installation or performance
- Any other relevant environmental or usage factors
The chiller must not be damaged, altered, or modified in any way from its original condition at delivery.
Cosmetic damage, such as scratches, dents, or other visible defects, will void eligibility for return.
4. Delivery and Installation Costs:
Original delivery charges paid by you are non-refundable.
Installation costs are not covered under this guarantee and remain your responsibility.
5. Installation Requirements:
The chiller must be installed and operated strictly according to the provided installation guide and product manual. Failure to adhere to these guidelines will void eligibility for return under this guarantee.
6. Usage Documentation:
In the event of a perceived performance issue, customers may be required to provide basic documentation such as photos, videos, or temperature logs to validate performance concerns and assist in troubleshooting.
7. Teething Issues and Troubleshooting:
If you notice any issues upon installation or during the first few uses, please contact us immediately. Many initial setup or "teething issues" can be quickly resolved with our assistance.
Common simple teething issues include:
- Incorrect flow rate through the heat exchanger
- Attempting to turn on the chiller without the pump running
- Electrical connections not fully secured
If issues persist, our team is available to provide guidance and address your concerns swiftly to ensure optimal performance.
8. Return Process:
To initiate a return, please contact our customer support within the 30-day guarantee period.
The chiller must be safely prepared for transport by securely screwing it onto a suitable pallet, exactly as it was delivered, ensuring adequate protection and readiness for pickup. Customers are responsible for any damages resulting from improper pallet preparation.
The chiller must be available for pickup within 7 days of initiating the return request.
We will cover the costs associated with the collection and transportation of the returned chiller back to our facility.
9. Refund Conditions:
Refunds will be processed within 7 business days after the returned chiller is received and inspected at our facility.
If the chiller is found damaged or does not meet the conditions outlined above, we reserve the right to adjust the refund amount accordingly or refuse a refund entirely. Partial refunds may be considered for minor issues at our discretion.
Photographic or video evidence may be taken at pickup and upon inspection to document the chiller’s condition.
10. Exclusions:
This guarantee does not cover damage caused by improper installation, neglect, misuse, or unauthorized modifications.
Any costs related to installation or disconnection of the chiller, including plumbing, electrical work, or site modifications, are not covered by this guarantee.
This guarantee is for products purchased directly through Bergs. It does not cover products purchase through resellers unless confirmed in writing from Bergs.
11. Right to Amend:
Berg’s Chillers reserves the right to amend these terms and conditions at any time without prior notice, with amendments applying only to new purchases from the date of amendment.
By purchasing a Berg’s Chiller, you acknowledge and accept these terms and conditions. Our commitment is your complete satisfaction, ensuring your investment is protected and your experience exceptional.
